These Terms of Service (hereinafter "ToS") aim to define the terms and conditions of use of the EVA Bet site, published by the GML E-SPORTS association (SIRET 104 572 730 00018, RNA W353026060), whose registered office is at 23 allée des Açores, 35200 Rennes, France, represented by its management board composed of Baptiste Marchal, Frédéric Faraux and Romain Gadani (collegial governance provided for by the statutes), with Baptiste Marchal as publishing director, accessible at evabet.gg (hereinafter "the Site"), as well as the rights and obligations of users. The Site is a free community prediction platform dedicated to esports. The brands, corporate names and game names mentioned on the Site belong to their respective owners and are used for purely informational and reference purposes. Any registration or use of the Site implies unreserved acceptance of these ToS.
Certain features of the Site (in particular the "Organizer" subscription) are governed by the General Terms of Sale (GTS), available at evabet.gg/cgv, which prevail over these ToS for all aspects relating to payment, billing, subscription duration and right of withdrawal.
Registration on the Site is free and open to any natural person aged at least 15, in accordance with article 45 of the French Data Protection Act regarding the consent of minors. Users commit to providing accurate information upon registration and keeping it up to date.
Each user chooses a unique username and provides a valid email address. Registration can be done via the Site's form or a third-party service (Discord, Google). The password is personal and confidential. The user is solely responsible for the security of their credentials and any activity carried out from their account.
The user is solely responsible for all actions carried out from their account. In case of suspicious or abusive account use, the editor reserves the right to suspend or delete it without notice.
The Site offers a free prediction service allowing users to predict the results of esports matches. Users accumulate points based on the accuracy of their predictions and are ranked in leaderboards.
EVA Bet is NOT a real-money betting site.
No real money is wagered by users. Points awarded are purely virtual and have no monetary value. They cannot under any circumstances be exchanged for money, goods or services. The Site does not fall under gambling regulations.

The design, texts, graphics, logo, source code and editorial organisation of the Site are the exclusive property of the editor, and are protected by copyright law (in particular article L. 112-2 of the French Intellectual Property Code for software) and by other applicable intellectual property provisions.
The user shall not reproduce, copy, sell, distribute or exploit all or part of the Site's own content without prior written authorisation from the editor. The brands, logos, names of teams, games or competitions mentioned on the Site are the property of their respective owners and are used for purely informational and reference purposes. Factual public data (match results, schedules, scores) is not covered by this clause.
Users may create teams, competitions, choose names or logos, and publish other content on the Site. The user warrants that they hold the necessary rights to the content they publish and that this content does not infringe third-party rights (copyright, trademark rights, personality rights).
By publishing content on the Site, the user grants the editor a non-exclusive, free, worldwide licence, for the legal duration of rights protection, to reproduce, represent and adapt said content, for the sole purposes of operating the Site and promoting the EVA Bet community (notably on its Discord, Instagram and partner channels).
The editor may, in its capacity as host within the meaning of article 6 of the French Act for Trust in the Digital Economy (LCEN), remove any content that is manifestly unlawful or contrary to these ToS, following a notification made in accordance with article 6-I-5 LCEN or upon becoming aware by any other means. Any unlawful content may be reported by email to asso.gml.esports@gmail.com specifying the URL, the nature of the content and the grounds for notification.
In case of breach of these ToS, the editor reserves the right to suspend or delete the relevant user's account, without notice or compensation. Points and rankings associated with the account will then be reset. In case of serious or repeated misconduct, the editor reserves the right to permanently ban access to the Site. Any decision to restrict, suspend or delete an account is reasoned: the grounds and redress options are communicated to the user at their next login attempt and remain available upon request at asso.gml.esports@gmail.com, in accordance with Article 17 of Regulation (EU) 2022/2065 (DSA).
The user can request deletion of their account at any time from their personal space settings. Once the request is made, a 30-day grace period applies during which the user can cancel the request and recover their account.
After this period, the account is permanently anonymized in accordance with the GDPR (article 17). Personal data is deleted or anonymized, and associated predictions and statistics are no longer linked to the user.
The editor makes every effort to ensure the availability and proper functioning of the Site. However, they cannot guarantee permanent availability and cannot be held liable for:
The editor reserves the right to modify, suspend or discontinue all or part of the service at any time, with or without notice. Access to the Site may be interrupted for maintenance. The editor will strive to notify users within a reasonable time in case of scheduled interruption.
Since registration on the Site and use of the prediction service are strictly free of charge, no sum being due under the ToS, the right of withdrawal provided for in articles L. 221-18 et seq. of the French Consumer Code, applicable only to contracts concluded for valuable consideration, does not apply. The specific terms of the right of withdrawal relating to the paid "Organizer" subscription are defined in article 9 of the General Terms of Sale, which provide for a 14-day right of withdrawal voluntarily extended to all subscribers.
The collection and processing of personal data, as well as the use of authentication cookies, are described in our Privacy Policy. By using the Site, the user acknowledges having read this policy.
The editor reserves the right to modify these ToS. Any substantial modification is notified to the user upon their connection to the Site and their acceptance is collected by explicit validation via a dedicated mechanism (checkbox or acceptance modal). In the absence of acceptance of the new ToS, access to features requiring an account may be suspended until the situation is regularised. The date of last update is indicated at the top of this page and the history of versions is kept by the editor for evidentiary purposes.
In accordance with articles L. 612-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably with the editor, the consumer user has the right to have free recourse to a consumer mediator. The referral to the mediator must be preceded by a prior written complaint addressed to the editor, within one year of this complaint.
Mediator's details: designation in progress with a body approved by the Commission for Evaluation and Control of Consumer Mediation (CECMC). Full contact details will be published before the actual launch of online payment.
In accordance with article 14 of Regulation (EU) No 524/2013, the consumer user residing in the European Union may also use the European online dispute resolution platform available at: https://ec.europa.eu/consumers/odr.
These ToS are subject to French law. In the event of a dispute relating to the interpretation or execution of these ToS, the parties shall endeavour to find an amicable solution. Failing this, the competent French courts will be seized. In accordance with the provisions of the French Code of Civil Procedure, the consumer user retains the right to bring the matter, at their option, before one of the courts territorially competent under common law rules, or the court of the place of their domicile at the time of conclusion of the contract or occurrence of the harmful event.
Donor badges are honorary distinctions attributed randomly and uniformly among badges not yet owned for each donation made through the platform. They are strictly personal, non-transferable, non-exchangeable between accounts, have no market value, and cannot give rise to any refund, conversion or transfer. Their attribution constitutes a symbolic acknowledgment by the association and not the economic counterparty of a service or a good.
